TERMS OF SERVICE — MAMA NEST

1. OVERVIEW This website is operated by Mama Nest. By visiting and purchasing from this site, you agree to be bound by these Terms of Service and all applicable South African laws, including the Consumer Protection Act 68 of 2008 (CPA), the Electronic Communications and Transactions Act 25 of 2002 (ECTA), and the Protection of Personal Information Act 4 of 2013 (POPIA).
2. ELIGIBILITY By using this site, you confirm that you are at least 18 years of age, or that you have the consent of a legal guardian to make purchases on this site.
3. PRODUCTS We reserve the right to limit the sale of products to any person, geographic region, or jurisdiction. Product descriptions and pricing are subject to change without notice. We shall not be liable for any inaccuracies in product descriptions.
4. PRICING & PAYMENT All prices are displayed in South African Rand (ZAR) and are inclusive of VAT where applicable. We accept payment via the methods displayed at checkout. Payment must be received in full before orders are processed and dispatched.
5. ORDERS & CANCELLATIONS Once an order is placed and payment confirmed, it enters processing immediately. Cancellations may be requested within 24 hours of placing the order by contacting us at [your email address]. After 24 hours, cancellations cannot be guaranteed. In terms of the CPA, you have the right to cancel a fixed-term agreement with 20 business days' written notice.
6. DELIVERY We deliver within South Africa. Delivery timeframes are estimates only and may vary due to courier delays, public holidays, or circumstances beyond our control. Risk of loss and title for items pass to you upon delivery.
7. RETURNS & REFUNDS In accordance with the Consumer Protection Act, you have the right to return goods within 5 business days of delivery if the goods are defective, not fit for purpose, or not as described. Please refer to our full Return & Refund Policy for detailed procedures. Items must be returned in their original condition and packaging.
8. PRODUCT SAFETY All baby and children's products sold by Mama Nest are intended to meet applicable South African safety standards. It is the responsibility of the purchaser to ensure products are used as directed and are appropriate for the child's age and development stage.
9. PRIVACY & PERSONAL INFORMATION We are committed to protecting your personal information in accordance with POPIA. Please refer to our Privacy Policy for full details on how we collect, use, and store your data.
